Crybell Terms of Use
These terms govern the use of Crybell, the Android app (com.morph21.crybell) that listens for a baby's crying and wakes a parent with a notification or an alarm, including its paid Premium features. Polish version: Regulamin.
1. Who provides Crybell
Crybell is provided by:
Krzysztof Gruszczyński APP
ul. Powstańców Śląskich 176/30
53-139 Wrocław, Polska (Poland)
NIP: 6351826533 · REGON: 525095630
E-mail: crybell.app@outlook.com
In these terms, "we" means the provider above, "you" means the person using the app, and "consumer" means an individual using the app for purposes outside their trade, business or profession (under Polish law, this also covers a sole trader who buys Premium for a purpose that is not professional for them).
2. What Crybell is for
Crybell listens for the sound of crying and alerts you with a notification or alarm so you can attend to your baby. It does not monitor health, breathing or vital signs. Sound is analysed only on your phone. Detection can fail (battery, other apps using the microphone, noise, distance); it does not replace adult supervision or safe-sleep practices.
This app only listens for crying. It does not detect breathing problems and does not reduce the risk of SIDS. Follow safe-sleep practices.
This app is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Always consult a healthcare professional for medical advice, diagnosis, or treatment.
Crybell is meant for adults (18 or older) who look after a baby and sleep in the same room as the baby. Listening and the alarm work on one phone, placed near the baby; Crybell does not send alerts to other phones. You can share the log on up to 4 phones (shared log).
The hint at the alarm (one fact from your log, with its typical range or with what helped before) comes from your own log and your "What helped?" answers, never from the sound of the cry. It is everyday information, not medical advice. The article about crying and the "When to call a doctor" card are general information, the same for everyone; they do not replace contact with a doctor, a midwife or the emergency services.
3. Limits of detection: please read before use
Crybell can help you notice crying, but it cannot guarantee that it hears every cry or that every alert reaches you. These limits are part of these terms, which you accept in the app before you first use it; the app also shows them in Settings → About → "Intended purpose and limits". In particular:
- Detection depends on distance, on where the phone lies and on background sound. White noise, a fan, a TV or music make it weaker.
- Phone calls and other apps that use the microphone pause listening. Crybell warns you when this happens, but it cannot hear crying in the meantime.
- While the alarm sounds, Crybell cannot hear; it checks for crying in short pauses between alarm cycles.
- A "Do Not Disturb" mode set to total silence blocks the alarm, and some phone settings can mute or delay notifications.
- Some phone makers close apps in the background. If Android closes Crybell, it can still show a notification asking you to resume. It sounds once, with your ordinary notification sound, not an alarm, so in silent mode or "Do Not Disturb" you may not hear it. Crybell cannot play its own alarm until you resume. If the app is force-stopped, nothing can warn you until you open it again.
- A flat battery, an unplugged charger, overheating or a restart of the phone can stop listening.
- A parent who is deaf or hard of hearing needs a smartwatch that shows the phone's notifications with vibration.
To get the most out of Crybell:
- put the phone on a firm surface 0.5–1.5 m from your baby's head, outside the cot and out of the baby's reach, never under a pillow or blanket, with the charger cable away from the baby, and closer to the baby than a white-noise machine or fan;
- go through the night readiness checklist, run the alarm test and, if you can, a test night;
- keep the phone charging overnight;
- keep checking on your baby as you normally would.
4. Using the app: agreement, requirements, price
The agreement for the free use of Crybell is concluded when you install the app and accept these terms in it. It lasts until you uninstall the app, which you can do at any time without giving a reason.
Crybell's free version costs nothing. Listening, every alarm profile, the night watchdog, the log, the shared log and the full history are free and have no time limits.
Technical requirements: a phone with Android 10 or newer, a working microphone, permission to post notifications and, for purchases, the Google Play Store. Listening works without an internet connection; ads, purchases and the shared log need one.
The shared log connects the phones of people you invite with a code shown in the app, and uses Google Firebase services (Firestore, Authentication, App Check) and the Google code scanner, so a phone without Google Play services cannot join. You are responsible for whom you show the code to: every connected phone sees the whole log, can change it and can remove another phone from the shared log. What is sent and how is described in the Privacy Policy.
You may not use Crybell to record other people without their knowledge or in breach of the law.
We may stop providing the app or its updates. If we do, we will tell you in the app at least 30 days in advance, unless we have to act sooner for legal or security reasons. We will not deliberately disable features you have paid for.
5. Premium
Premium is a one-time purchase made in Google Play, not a subscription. It removes ads and adds statistics for 30 and 90 days and short cry clips (optional, kept on your phone). Detection and the alarm are never part of Premium: they stay free.
The price, including VAT, is shown in Google Play before you buy. The payment is handled by Google Play under its terms. Premium is linked to the Google account used for the purchase; on a new phone, use "Restore purchase" in the app.
Premium is unlocked as soon as the purchase is confirmed. If, when buying, you agreed to immediate access and acknowledged that you would lose your right of withdrawal, the 14-day right to withdraw from a distance contract does not apply (Article 16(m) of Directive 2011/83/EU, implemented in Poland by the Consumer Rights Act). This does not affect your rights if Premium does not work as described (section 7), nor any refund that Google Play offers under its own refund policy. To ask for a refund, use Google Play or write to us.
6. Ads
The free version shows ads served by Google AdMob, as described in the Privacy Policy. Ads never appear on the listening or alarm screens. Premium removes them.
7. Conformity and complaints
We are responsible for the app, including Premium, working as described in these terms and in the app, as provided by law. Consumers have the rights set out in the Polish Consumer Rights Act, which implements Directive (EU) 2019/770 on digital content and digital services: in particular, to have the app brought into conformity, and, where the law allows, to a price reduction or to end the agreement and get a refund. We provide updates, including security updates, needed to keep the app in conformity for as long as the law requires.
You can send a complaint to crybell.app@outlook.com. Please describe the problem and include the app version and your phone model, if you can. We will reply within 14 days of receiving the complaint.
8. Liability
Nothing in these terms excludes or limits:
- our liability for damage caused intentionally or through gross negligence;
- our liability for death or personal injury, where the law does not allow it to be limited;
- liability under product liability law;
- your statutory rights as a consumer, including the rights in section 7.
Within these limits:
- Crybell's purpose and limits are those described in sections 2 and 3. A cry that is not detected, or an alert that does not reach you, for one of the reasons described in section 3, is a known limit of the app that we tell you about before use.
- We are not responsible for services provided by third parties, such as Google Play, Google AdMob, Google Firebase (Firestore, Authentication, App Check), the Google code scanner or your phone's system, beyond what the law requires.
- If you use Crybell in your business, our liability to you is limited to the price you paid for Premium and does not cover lost profits. This does not apply to consumers.
9. Licence and intellectual property
We grant you a non-exclusive, non-transferable licence to use Crybell on your devices for your personal, non-commercial purposes. You may not copy, sell or modify the app, or decompile it beyond what the law allows. Crybell includes open-source software and a sound model, used under their own licences, which are listed in the app under "Open-source licences".
10. Personal data
How we handle personal data is described in the Privacy Policy: https://crybell.pages.dev/privacy-policy-en.
11. Changes to the app and to these terms
We may update the app, for example to fix errors, to improve detection or to follow changes in Android or in the law. We will not change Premium in a way that takes away features you paid for, unless the law requires it.
We may change these terms for important reasons: a change in the law, a change in the app's features, or security. We will show the new terms in the app at least 14 days before they take effect. If you do not accept them, you can stop using the app and uninstall it; if this concerns Premium, you can also end the agreement as provided by law.
12. Applicable law and disputes
These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you usually live.
Disputes are decided by the competent common courts. A consumer may also use out-of-court help: in Poland, for example, the municipal or district consumer ombudsman (rzecznik konsumentów) or the Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej); in other EU countries, the European Consumer Centres.
These terms are available in Polish and in English, with the same content. If the two versions can be understood differently, the reading more favourable to the consumer applies.
